Nella successione testamentaria gli eredi e i legatari possono essere stati indicati dallo stesso de cuius, ancora in vita, con il suo testamento. Fino a quando l’accettazione non sia notificata al donante, entrambe le parti possono revocare la loro dichiarazione. La donazione di beni mobili, deve indicarne il valore, pena l’invalidità dell’atto.
La donazione, investe anche la divisione ereditaria, dovendo imputare alla propria quota ereditaria, il valore del bene donato, al fine di ristabilire la proporzionalità delle quote tra gli eredi, prima di formare le porzioni e assegnarle.
